Do you or anyone who thinks that backlogs are due to labor substitution have any proof to claim so ?
Even if there were some, they definitely won't be in large numbers. First of all to use a sub labor, one labor had to become available. Do you think there were so many labors floating around to grab one ? I don't think so.
How come EB3 ROW went "U" if all the backlog was due to labor subs ?
Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even though they are few...the impact is big... With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. The 3000 - 5000 is just a conservative realistic guess.. not based on any data. Do the Math !!! You might agree !!!

That sounds like a good plan, but I didn't see a provision for people applied for I-485 and waiting for their dates to become current to add their spouses ? ( Disclaimer : I'm not one of them :) ) How is that going to get tackled ?

Again, this depends on how zealous the prosecutor and child protection services are.
Depending on how your attorney advises you, proceed to inform the authorities.
Trust me man, I have done projects with state and county level agencies and this is serious stuff and you need to act now to get in the driving seat. Inaction is NOT an option.

Isn’t it odd that the timing of your rally coincides with the introduction of the Strive act?
Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.

First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.
From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.
You can file for prosecution under child abuse and I am sure this case would be prosecuted legally, even though the care provider was un-licensed and illegal alien. Your proof however (video recording someone without consent) may be disputed.
But the bigger question is your admission of entering into contract with individual not permitted by law to engage into such contracts. This might be mis-denemor or something greater. Check your legal options first.

Actually, it has been mentioned several times since past few years that the RD that you see online is infact the ND. This is NOT the date the the CLAIMS3 system sorts by. Whether it takes 2 days for someone to enter the data or 2 months the RD date is fixed - it is the date they receive your application. While entering data they look at this received date stamp and enter that as RD.
Many National Customer Service (call center employees) only go by what they and you see online and hence give your ND as RD. The ND by far carries no value for sorting and priority purposes.
Majority of IIO's at service centers will mention RD as the date of relevance as they look directly into the CLAIMS system and are better informed than call center employees or Infopass IIO's !
I really hope that clears the confusion....

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item

Eg:

INSTEAD OF:

If the authorities were really clever they should have accepted the 65000 with highest salaries instead of doing something random like a lottery. This in turn would have forced employers to raise wages to have a meaningful shot at getting a visa.

The petition looks great! I'm languishing in the queue since March 02 (PD early 2002). No IO is willing to listen to anything about my case. Sometimes I hink we should meet up with USCIS director and explain how unfair the whole system works and how individual cases have suffered!

Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Engineering and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
I have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV
As another fellow IV member who just sent me his story clearly mentioned, and I quote him
'Hope my story adds another spoke in the wheel. The thought of having to wait 2-3 or even more years just to be able to file the I-485 is damning. It's time to quit whining and do something about it. Want y'all to know that I'm available to help out in any way I can.'

Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Engineering and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
I have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV

Like in the movies Rang De Basanti .. newer generation was compared to Freedom Fighters and like in Lage Raho Munna Bhai -we had Non Violence portest Heroes, I am seeing very comparble Heroes in the Immigration Voice Core team. Chandu - Can I Ask you something here.
Just today I was reading on the ac21 thread, how you lamented that we as a community dont stand up for injustice and how some folks are worried that writing AC21 letter may mess up their situation somehow ......
And right now , you are suggesting that the best thing is to get out of any kind of mess. So the person knew he was doing something illegal and his 8 month old kid was beaten up and you feel he paid the price and now No Problem and he should move on ???????????
Somehow, this 2 + 2 isnt equating 4 for me. What am I missing here ?

You misunderstood my point here. Everyone are doing things at their own risk and must be ready to face any consequences.

You have some people advertising that they provide nannies for elderly care, child care, they provide food on daily basis and also provide cooks for occasions, services ranging from janitor work, to helping with groceries and all sorts of stuff.
This industry is big - very very big. Some agencies did tell us they have nannies on j1 visa.
We on this forum who are very vocal are the most innocent folks in the world when it comes to this kind of stuff and we have a straight tangential approach of punish someone for beating the kid.
Well - lets use our brains instead. Believe me - our community does not have any sympathy, because we are not united.
People can come on this forum and give advises - but the person who implements it must know what he can expect and that's why he posted here. Our friend is on h1b and maybe having his 485 pending and he must have careful thoughts before he leaps into something.
What is the guarantee that a certified nanny wont ill treat the child. I have heard that nannies need not beat the child but do give mild sedation to babies in their milk so that the nanny can be in peace. If a nanny is doing that do you think she will be caught on tape?
There are tons of things nannies do and you may never be aware of it or may not be caught on video tape.
