Labor substitution was never illegal unless you have purchased it. Hijacking the priority date is incorrect according INA. If you are not feeling pity about the fellow immigrants who suffered injustice (also from India) you are selfish a individual. FYI more than 60% of the 2007 July fiasco were substitutes I am neither IV core nor you (as per Profile). So all these guys can do is to bring this issue to their attention. I believe if the case has been pre-adjudicated then it shouldn't matter whats the RD and ND. They will probably approve based on Priority date. Earlier PDs get approved first. But who knows, its USCIS.

I had to be persistent with my complaint with the Ombudsman. Finally I got it later in the year. When I sent my complaint in, sometime in July 08, I thought I was among the few who were left out. But this thread suggests that there are a lot who were bypassed when they gave GC's to PD's in 2005 and 2006 last year.

but we are not there yet. We need EVERY active member to contribute at least $20, remember there are not that many active people here.
It's very encouraging to see that some of the contributions are from recent members. Maybe pappu can let us know at some point how much this campaign has collected so far.

The concept of pre-approval/pre-adjudication have been practiced by USCIS since 2005. Though, it is not in their law or SOP or regulations, they are practicing now and before for ease of operation in processing the 485s. As per their current official rule, if a visa number is not immediatly available, the 485 shoul be kept in abayance (not to be processed) till VN again available. But practically it is not possible for them to follow. For example, suddenly, if DOS releases 60,000 visas in a month (like july 07 fiasco), they can not process and approve 60,000 485s in a month, if they keep those files in abayance. I think, they are still processing and pre-approving the 485s during retrogression. The concept of pre-approval in a silent internal procedure. They may pre-approve all the cases. However, they always has a right to check the applicant's eligibility for the approval of 485 at the date of approval of 485. One can not expect them not to send RFE/NOID after it is pre-approved. Unless the law changes drasticlly, it is not a easily achaivable benefit to introduce new immigrat status "pre-approved adjustment cases"for long waiting 485 folks. They clearly argue that benefit of AC21,EAD and AP itseltf a great benefit for 485 folks. There are only 3 immigrant catagory in the law. 1. Non-immingarts 2. Immigrants and 3. Pending to adjust status. Pending to adjust status it self a fluid temporary status as the stay in this status is autorized by attorney genreral. It is not a visa status like H1B or green card. In order to bring a new catagory in this status, I think they need to change the INA.

Sherman, I'm glad you are trying to find answers by talking to IV. Though, you have a lot to read up on about immigration.
US has always had strong immigration. That is why US is where it is today. It would be impossible for any country to grow that fast without immigration.
Immigration today versus 100 years ago are very different.
100 years ago, the only requirement to get into the US was that you were not too sick to work and then you got your green card within 3 to 5 hours(!).
Today, you need to have education, a job before you even get here, your job has be verified that no American can do it instead, you can not be sick, you have to prove you or someone else has financial means for you to live here, you have to be fingerprinted, can not committed any crimes in the world and more and more. And on top of that you have to wait 5 to 10+ years to get a GC.
I recommend a trip to Elli's Island i New York. It was fun to hear Americans awwing when they heard the poor immigrants back then sometimes had to stay at Ellis Island for weeks, when they were sick. Comparing a few weeks to the years(!) it takes today, I think many would easily pick a few weeks wait over 10 years wait.
