Guys, any reason why we have a whopping 70% of the members not interested in contributing to this idea??
There is nothing illegal or offensive in a humble protest, so why the lack of interest?? Are you worried that you'll be pulled up for a humble protest?
It's not even that expensive to send a bunch of flowers. We have to come together and do something here to implore the USCIS to reform the immigration process. Just lurking around , and not doing anything about this is not going to bring about any reforms to this dysfunctional system.
I would love to know the rationale behind your lack of interest. Appreciate if you can speak up as to why you wouldn't want to join in. Atleast let us know if you have a better idea. Doing nothing and playing the wait-and-see game is probably the worst option.

This idea will just put another layer on the GC process. If you are going to make a rule/law to allow this 5 year EAD and new status, why not instead change the LAW to allow higher numbers of yearly GC cards or remove the country based limits.

Do you know why all arguments against F1 to GC are moot? It's because US does NOT view it as misuse. They are talking about not letting the students go, and stapling GC's to certificates. Do you think there will be any result from fighting that sentiment?

FBI check delay is admin procedure so courts could take up the case. But per country quota is law.
Many persons used to say skills need to be basis for selection. But that is not applicable for GC processing. Here there is no selection from multiple candidates. In Labor and I140 they are checking that particular candidate is suitable for that position or not and also no US citizen is available for the job. If not they will reject the candidate. So they are not selecting based on Merrit as no compettion is there for the particular position. So it is just all the eligible persons will get GC. It is similar to all the high school passed candidates will get admission to college if seats are available but not based on marks but based on FIFO basis.
By FIFO based it is discriminatory but still unused other country quota is used in last quarter for India and China. So per country quota impact will be less if CIS uses all the 140K. Also they are not giving any one country preference or quota. So it is not outrageous compared to many other controversial laws. Law in any country is not perfect and even if perfect it will give more benefit to some group.
It is very difficult to win by lawsuit against any law unless that law is outrageous and impacts many persons. So best way is to try for another law to change a law. But just removing per country quota will give very less benefit especially for Eb3. Waiting time will reduce from 7 to 6 years for all countries. If per country quota is removed with recapture bill then waiting time for EB3 may reduce to 1 to 3 years for EB3.
I also personally think the lawsuit is the better way, especially in the election year.
It can produce one of the three results:
1> We Win... Everything is fine.
2> We Lose... At least the thing got settled and it is clear that the US can create discriminatory laws.
3> Force Congress & the US govt. to expediately state its stand & justify the stand on the per country quota limit in employment based immigration.

The good thing about the US is the case gets settled/decided ASAP, and it would make sense to give the lawsuit a try.

Granted Native Americans were here first but at that time America was just a land inhabited by people and it was not a nation. A nation is defined as having the following characteristics (These are UN definitions)
1. Has space or territory which has internationally recognized .
2. Has people who live there on an ongoing basis.
3. Has economic activity and an organized economy. A country regulates foreign and domestic trade and issues money.
4. Has the power of social engineering, such as education.
5. Has a transportation system for moving goods and people.
6. Has a government which provides public services and police power.
7. Has sovereignty. No other State should have power over the country's territory.
8. Has external recognition. A country has been "voted into the club" by other countries.
So America was never a nation before it became America.
Regarding you second point about Columbus, Christopher Columbus was not here look for a promised land, he and other pioneers were here to find trading opportunities. Get your history straight, India was known for Spices and Gold at that time and the pioneer wanted a piece of it. Now India has nothing to offer, other then a piece of its humongous population.

It seems to me that he just shared the information that he got and the way he understood. Would anyone else have done it any differently?
I dont think it really matters whether they have used up all visas now vs at the end of sept. Because, there were "X" number of visas to be given out and so "X" number of applicants would be chosen randomly (USCIS Lottery style..:p) and that happend...
If at all, this is a good news, that they actually finished this lottery process and so nothing will go to waste...(It would be too bad if california Lotto comes out with a winner number ticket that does not belong to anyone!!!)

Very well said. I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"

I have been living in US for close to 10 years now and though I am proud of fellow Indian community and their achievements, I have also noticed how the community is divided and oponionated. Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....
If everyone in this world want to be considerate and help - then there will certainly be a day when we can see a world without poverty, wars and all the issues we are having today.

What I and the majority of people in this forum do is their best to make sure they dont loose their status. If on the other hand it happens I would return to India and consider all options to reverse it. What I and majority of people here wouldnt do is stay here illegally. Loosing you status is not a crime for which you are shackled and put in a detention center. A repeated pattern of violating the law is.

Many are saying there won't be any IO at ASC. Not true, when I went in for Finger prints, I asked the lady who takes the finger prints about enquiring about my I-485 status! She said, she can't help, as she does not have the access and told me to call the 1-800 number and also try asking the IO at the window as there are not many people waiting and is the IO is free she might help.
SO, after finger prints, I went back into the office and there was only one guy talking to the IO another lady was waiting. I asked the lady, if she was waiting for the IO, she said she is here with her husband. She's an African American lady and her husbandwas inside the Fingerprinting room, I am guessing this as that guy sounded like from Africa and may he's a Family Based visa applicant.
Aftert the guy at the counter finished his work, I went to the counter as no one else was waiting there. I asked IO, a nice lady, if she could help me with the Status of our Name Check. SHe asked me, if I had an appointment, I said no, but I had a finger print appointment and I could not get an Infopass appointment around the same time (I had finger print appointment at 3 PM and I did try to get an Inforpass appointment around that time so that I could enquire about the status too, but there was none around that time and the closest one was around 12:45 PM, so I thought I would just try my luck).
She then said, we just received this memo and let me read it and said this supersedes everything and even everything is clear for you nothing will happen, asking me if I was from India/China hesitantly as she could fingure out I was from India, untill new visas are allocated in October. She then took our I-485 receipts and went inside to check the status of our applications.
I am in Midwest and not all the USCIS/ASC offices treat as bad, as these guys may not have that many applicants coming to the office, like int Northeast or California.
I had talked to her earlier also, after taking an Infopass appointment, as I had receive someone else's EAD and went to return so that the actual person would get her EAD. Last year USICS had sent some one else's EAD to me, the EAD was some one else's, but the letter it comes with was in my name (I had also received my EAD separately, strange are the ways USCIS works and I don't have to tell the guys at IV). Then also, she check status of our applications and told out namechecks were not cleared and finger prints were cleared. SHe even told, even if my wife's checks are cleared they would not apporve her untill my applications is approved. SO, I had this hope that this lady might help this time without Infopass appointment.

I will give you a couple of reasons, why I am not supporting this idea, at the same time I won't discourage you from doing it:
Last year when CIR was being discussed in Senate, anti-immigrants sent thousands of bricks to Senator's offices. Bricks build walls, their message was clear, focus on border security first. This was a -ve campaign. It was popular in the right wing media but since CIR passed in Senate. I am presuming this campaign didn't work. The reason it failed was because the idea was to grab headlines but no thought on what after that. No strategy. Lets correlate this with flowers. An officer at USCIS will get these or maybe a dozen people. They will feel good. End of story. They don't have the ability to change the USCIS policy or the July bulletin, which is IV's aim. So basically sending flower is a gushy gesture and may sound fancy but USCIS doesn't work on emotion. If it did, why would they loose thousands of visas each year even though there is rampant backlog and retrogression?
Some members say well, flowers will attract media attention and hence help our cause. Well, unless Paris Hilton is sending those flowers you won't get much media's attention. Indirect, subtle and passive communication doesn't work in America. That is a cultural issue that these members need to come to grips with fast.
Our goal is to make USCIS accept July applications for AOS for GC. Since USCIS won't do that whats the best way to do it, well to exert external pressure. How is that done. Contact Media, Senators, Congress members and the Judicial system.
Too much babbling on my part, now, I am going to write a journalist requesting more media coverage on our issue.

We are not sending pen, paper and cal to caluclate the accurate VB. And one more thing we are not fighting for it, just we are telling how badly we effected with the "flip flop" game of USCIS.

When you are writing to journalist mention about the JULY 10TH FLOWER DAY!! I am sure she/he will ask couple of questions abt it.

Last year when CIR was being discussed in Senate, anti-immigrants sent thousands of bricks to Senator's offices. Bricks build walls, their message was clear, focus on border security first. This was a -ve campaign. It was popular in the right wing media but since CIR passed in Senate. I am presuming this campaign didn't work. The reason it failed was because the idea was to grab headlines but no thought on what after that. No strategy. Lets correlate this with flowers. An officer at USCIS will get these or maybe a dozen people. They will feel good. End of story. They don't have the ability to change the USCIS policy or the July bulletin, which is IV's aim. So basically sending flower is a gushy gesture and may sound fancy but USCIS doesn't work on emotion. If it did, why would they loose thousands of visas each year even though there is rampant backlog and retrogression?
Some members say well, flowers will attract media attention and hence help our cause. Well, unless Paris Hilton is sending those flowers you won't get much media's attention. Indirect, subtle and passive communication doesn't work in America. That is a cultural issue that these members need to come to grips with fast.

vijay226: The following is just my opinion and it is in no way a personal attack. Please come up with similar ideas like the one you just posted below. Useful or not, all ideas count as long as it is pointed towards solving the issue in a constructive manner.
Reply to your message: We should not propose a fee for this kind of administrative change. There are few reasons for that. 1) This is just a workflow change and an internal procedural change for the USCIS. 2) There is no need for any additional incentive for the government as this is in effect not taking anything extra from the US soil in terms of opportunity etc. 3) Any addition of fee requires administration to get it approved through the Office of Management and Budget (OMB) and it will make this a legislative affair. That means the whole assumption of getting it through admin fix becomes invalid. 4) In any case, if administration wants to make some extra money from us, they will come up with that proposal.

i think we are also need to provide some incentive to the government also for doing this,say some nominal fees around 600$ and any one contribute more than that will be tax free which goes into financial bailout package. At the end everyone wins and everyone is happy

there is such a huge backlog for Indians that even the news above won't help much... overflow from family category has slowed down and previous recaptured visas are over ..the news that CIR has been delayed could be good as there is higher chance that there maybe some sort of relief ..other than that the situation is HOPELESS !!!

Thats wrong. This is not being posted by private people. It is being delivered and packaged by FTD/1800 flowers and such known company.

I'm just saying make sure they are accepting them - can't you call FTD/1800 flowers and check if your flowers were delivered? It's a government building and they get really strict at times - I know because I work at one.
