I believe your answer below was related to this situation:
Consider this:
If someone renews his/her H1B after 6 years based on approved I-140. Assuming that dates are not current, the H1B gets renewed for 3 years.
In this scenario if the pending I-485 gets denied, what happens to the current H1B? Does that also get invalidated as it's renewal was based on a pending I-485 and approved I-140?
Thanks,
-Ski
AS I understand : After 6 years, the moment I-485 is denied H1 becomes invalid.
Employee-Employeer can be in agreement to use "Unauthorized work protection - 245(k) - six months", continue to work and immediately apply MTR.
This is complex area and I don't understand fully. Please don't give red dots for these tough questions. I already reduced giving answers from 5-6 per day to one in 5-6 day.

I sent that question in for the debate about 2 weeks ago. Glad it is on the list. I cannot access this link now for some reason
I guess we should use chances like these to get our agenda heard by the people and the govt. There are going to be atleast 3 more presidential debates we should try to get this question asked atleast in a couple of them. We can modify the question to make it more broad, but still keep the focus on legal immigration problems by highlighting it.
PS: You have earned yourself some green ;) I mean rep points from me

I have been a member of IV for a long time. I think my only contribution is when I contributed a few times for some of the efforts. I come to this forum maybe once in a quarter just hoping to see some good news on the immigration side. I see nothing, feel bad about it and leave without doing anything. Every time I leave thinking that I should start contributing instead of being a useless lurker, but somehow that thought is the end.
My mistake and I apologize to the regular contributors here.
Anyways I am going to contribute now. I have set up a reminder in my calender for every other day to visit IV and discuss with other members about the next approach to take. I am also looking to contribute whether it be writing letters or taking part in rallies or speaking to lawyers about the spillover.
Again I apologize and I am looking forward to our next step towards ending our immigration woes.

If USCIS is approving H1B/L1 applications, for any Software job, with a B.Com or B.A degree, then defenitely, it's a high time for it to change the rules for the H1B educational qualifications. I don't mind to port to EB1, if its accepting online degress, by getting a Ph.d deegree from a tri valley online university :D.
.
if one thinks thats wrong and USCIS needs to change then yes please approach through proper channels. definately, if possible to port using Phd from tri valley you may try..

Right on!
Well there are several added advantages like you mentioned.
What kind of business you do? If you don't mind asking.
Are you making money? (bottom line hehe)

How does that bother you? Thanks for the good laugh, BTW. :D

My attorney sent the I-485 papers on 7/16 and it reached NSC on 7/17 at 9:36AM. USCIS announcement to accept the applicatons was done on 7/17 evening. Will mine be in the potential rejection pile? Any input will be appreciated.

Exactly.. You apply now.. no way it is going to get approved in time.. substitution approval takes anywhere between 4 months to 1 yr. Most common I heard is 6 months. you try to slide just under the door.. they aren't going to be happy abt it..

I have logged in and voted for the Immigration Reform, link there. (Searched for Immigration as mentioned by @sri) But, again we have many other posts which are against legal immigration due to financial constraints.
Please avail this opportunity to vote and highlight our plight, by voice your opinion in the right posts.
Good job Oliver,
Please post this message that we can vote in as many threads as you can. Here is one more chance to vote, guys.

I think there is something wrong in lobbying of pro immigrants. Anti immigrants Convinced many Congressmen with facts and numbers that H1b wages are less than US workers. Pro immigrants should have collected accurate information about wages to counter their claims.

One more thing. Working on EAD can be preferred to both categories, ppl who has consumed all 6 years and ppl who haven't yet.
1. If you have consumed all 6 years, according to above link, can file MTR if 485 is wrongly denied due to AC21. EAD remains valid till atleast the appeal period. while if they are on H1 extension beyond 6 years, H1 is cancelled with immediate effect.
2. PPL who haven't consumed 6 years have an added advantage to come back to H1 and guess what, he can (if needed) start a new GC process while retaining his older PD (as his 140 was once approved, he retains that PD for life).
I found this by extremely intense research on internet, CIS website and many well-known lawyers forums, chats and discussion. However it is always advisable to consult your own attorney.
Thanks for the additional information. In case 1 - can the applicant still retain the priority date if s/he wants to start a new GC process? In other words, does 6 year expiration have any effect on retaining PD?
From what I have gathered so far, it appears that it's a misconception that a lot of people have who feel it's safer to stay on H1. It doesn't sound like EAD is as bad as I had once initially thought..

As there are now many people who are actively posting in the group. Identify and rotate the maintenance of the membership among these members on a weekly basis.
The ideas are good and in the past we have contemplated having a paid member area on IV site too. However the biggest problem we have is - who will manage it?
We all have full time jobs and already have our hands full. Adding anything extra to the current workload will be too much work for us.
Either we hire someone to do it. And to hire we need money. We find it hard to even raise money for Lobbying every other month. There are other important areas like publicity we can look at too if we get more funds. So we cannot hire anyone to manage this.
Now can someone volunteer for it? Yes but how many people come forward with a commitment in a 25k membership? You can see from the thread
http://immigrationvoice.org/forum/showthread.php?t=15289
So if people are not willing to make a commitment and have their spouses to help us from home for this cause, we cannot take our ideas any further. We can only do what our limited time, funds and manpower allows.
This is a reality and is the reason why we all do not have greencards till now. Solving this greencard issue is not difficult. Its only a matter of gathering enough people and people wanting to make an effort. IV has been around for 2 years now and only 25K people have signed up. We should have had about half million signups by now and millions of dollars to spend on large scale lobbying, media publicity and several initiatives to draw the attention of lawmakers on this issue. That has not yet happened and will not happen until we all indicate how badly we want greencards.

In my view, it is too good to be true. But we have no way to challenge the numbers either. But it is 50% of the entire EB pending cases. Is this document authentic?? I don't see the logo on the letterhead??

gimmi green - Don't you see green around you. Let me tell you how to get green
1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.
2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.
3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.
Am I doing it? Yes.. Did I make money? Yes.
Ensoy.

I don't like idea of making IV a commercial-type business. IV is for legal immigrants and it should be funded by Legal Immigrants, however, practically its not that easy as it sounds, and more importantly its not working enough for IV to operate and generate results that we are waiting for.
Problem is not that we dont have money as small as $20, issue is we dont want to pay. The reasons could be a)- we dont understand importance of IV, b)- dont trust IV fund management, c)- love freebies, d)- dont have money e)- everything else.
Lets talk about e)- there are 31000 reasons not to donate to IV. Well no matter how hard we push there will be people who will never contribute. I met quite a few who been saying yeah for quite sometime and visit IV almost daily but have not contributed $0.01. Cant help them who cant help themselves.
d)- dont have money: smells fishy, we are Hi-Tech workers, get paid really good and cant donate $20, I dont buy this idea. Better explain me next time.
c)- love freebies: its great concept, I like it too, but when IV is fighting for us, the whole legal immigrant community, cant we donate $20 for our own future. Lets take it as a lottery, we buy ticket, we may win and may not win, compare it to IV, we donate to IV, IV may be able to resolve issue before we even reach there in GC process (just like name check), and IV may not help retrogration, but still we come to forum, get information about process, discuss our own case, get seniors/gurus review of our own GC case/issues. We cant go wrong with that. Its doable, just $20 for all this.
b)- IV fund management: well IV has 25000 dedicated registered members, WOW, but way more than that IV has un-registered unknown number of enemies. Exposing everything on web is not a great idea, its like playing poker with your cards open. IV registration process is very simple and hence ANYONE can join and get sensitive info very easily and may use it against us. To protect that info IV is working on local chapters, local chapter registration is based on personal interaction, almost guarantees us that member is really legal immigrant. Once we are local chapter member then you get all such info in personal Inbox. You can see, verify, and discuss IV spending, see all transparent at this state chapter level. Just join them, no fee, its free!
a)- dont understand importance of IV: this is biggest single factor so far, folks who are in their 1-3 years of H1, assumes that by the time they will come to advanced stage of GC everything will smooth by then, as of today there is no reason for them to think about it. One very huge mistake they are making of thinking that GC queue will decrease when they get in line. It wont. It will keep increasing exponentially simply because number of cases come in line are far more than number of cases exit the line.
Delta = (# of new cases in the line) (# of cases exiting from line)
Trust me this Delta is getting bigger and bigger for you. Donating to IV may not seem important right now, think again you are going to invest in your future. IV may resolve this issues before you reach there. Ultimately saving you 2-3 yeas in GC process, you can earn more $$ in those 2-3 years and enjoy GC benefit too.
Wow, all this explaining to get $20 from each member. Please point out if there are other reasons for not donating to IV.

Hope is ok. But IV core has more access than normal members like lawyers, lobbyists. So their view is important. Atleast interpretation of Memo need to known to the members. Also feasiblity of succcess, amount of effort and money need to be known to the members. I am seeing silent in most lawyer sites like immigration-law, shusterman, ILW. Everyone posted memo but no one really that much bothered
I request you not to deviate from the topic. Lets hope IV core come up and support in this.
