This is one of the more reasonable proposals heard here. To give it more credibility, I think we should add an earnings threshold to it. Something like 500K to 1 million in cumulative W-2 earnings. No matter what your country of birth or your educational qualification is, If you contributed significantly to this country and you are law abiding then you deserve a little respect so that you can do more of the same.
Sir that will not go too far because it will be very easy for Desi body shoppers to generate W2s and pay stubs for that amount.
Make it simple. if someone working from last 10 years paying taxes and no crime history, never violated any law...Grant them Citizen ship...not GC.

This is a very good suggestion that should be seriously looked at...in order to get broad based support, we could also think about adding ability to file for I-485 when the dates are not current....this way the pool of people likely to be impacted will be large enough to reach a critical mass...

USCIS has just released their tally of cap filings as of 04/04/2007, Wednesday. In two days (04/02 and 04/03), they received 133,000 unique pieces of mail containing H-1B petitions, which turned out to be lower than 150,000 which they had initially reported. They reached the updated number following a physical count of the mail. Each piece of mail may contain more than one H-1B petition and it will take USCIS a substantial amount of time to open and sort through that volume of mail. It is a good news in a way that at the end, the total may turn out to be less than guestimate in the community and the rate of odds for winning in the lottery may be much more promising than the one initially anticipated in the rumors.
As of Wednesday, total they sorted out and each type of cases identified were as follows:
Total Sorted Out: 32,755
General cap cases: 28,052
U.S. Master or higher degree cases: 4,703
The USCIS promises to update report from time time as they continue to sort out the remaining packages.
It is surprising that the U.S. Master or higher degree cases are more or less higher than expected.

Not sure about the news, but based on my and our experiences with uscis,I have to say these two IO are EXCEPTIONALLY friendly. You can casually walk up to an IO after taking fingerprint? I thought you would be arrested if you go to any uscis office after taking the finger print. You will receive call from IO to give missing material? I suppose there is something called "RFE", and they are never afraid to use RFE, even for most minor and unnecessary reasons. Gee, if only half of the IO are good as this, there will not be any immigration problem anymore.

One of my friend received a call from IO Adjucating officer yesterday
and it seems adjucating officer asked him to hurry up to send his wife's medicals because
there were only 14K more visa numbers left as he did not include his wife's medicals (she was pregnant when they were filing I-485).
He received his approval notice but not his wife's due to the missing medicals
so relax guys - there could be atleast 13k visa numbers left.

Another member from CA has joined this challange. The member has contacted me and I have just now spoken to the member. The member wants to stay as an annonymous donor. So far he has contributed $1500 over the past few months. This member has pledged to pitch in with some more money when the total contributions from other members reach the 30,000 & 60,000 dollar mark. Your case may be preadjudicated.....(if at all that is actually true)....yet it does not stop USCIS from sending an RFE for anything especially it has been over a few months since they last saw ur case....and once an RFE is issued you again go back in the list and the wait continues to next year when the window again opens for a short time.
It is absolutely nonsense that preadjudicated cases are in a pile waiting for visa number...this is from my attorney....USCIS can issue n number of RFEs.....and each time it is issued it furthers the chance of green....

Dear friends, as I read all of your stories, I cannot help but relate it to mine. Even as I write this though, I am in the middle of a dilemma - I am being offered a promotion to a Director position and I cannot decide whether to accept it or not.
I have been in the US for over eight years on an H1 and have been working for a Fortune 20 firm as a Manager for the last four. My company applied for my Labor Cert back in Dec 2002 and while it cleared State in May 2003, the application was stuck in Federal processing for more than a year. Just as it seemed like they were getting to applications that had been transferred in during May 2003, the BEC took over and I literally felt like the rug had been pulled from under my feet! It's been almost two years since then, but I have seen no progress at all - zero, nada, zilch!
Meanwhile, I have been working hard at my company sorting my way through leadership changes, reorgs and changes in vision and strategy. While all of my colleagues and friends were applying to new positions and getting promoted, I lay low. Four years in the same job - I can tell you that is a looooong time! It isn't just that work starts to become a drag but also life itself seems to be in limbo and the frustration of the wait starts to spill over into personal life.
I got married two years ago and my wife, bless her heart, has been making a valiant effort to keep busy and pursue other interests, since she is on H-4. However, I know she can't wait to start working.
As all of you know, it takes a lot to succeed in the US economy and be recognized, but I have worked hard. Not only have I paid taxes for 8 years, but I also feel like I have paid my dues. I have an MBA from a top b-school and skills that are in demand. I cannot help but wonder, whether we are meant to waste our lives away?? You start feeling like a second-class human. I know I can always go back to my home country but I have invested a lot of my life here. We need justice!

Personally, I do think the above bill you requested in the #1) is extremely difficult to work. It is because there was a bill proposed to the EB-2/EB-3 applicants to occupy the annual DV-lottery of 55,000 quota but it is NOT becomed a law yet. Now is April, 2011 and the DV-lottery results of this year will be announced soon online and the coming year of DV-lottery will be drawn again later during this coming Oct, 2011 but there is still NO hope to give those EB-2/EB-3 applicants into this DV-lottery quota. If this quota is occupied by EB-2/EB-3 applicants, less applicants will be in GC line.
Also, there is a proposed bill to allow foreign US accreditated universities' advanced graduates of STEM and with a US job offer to have GC but again it is NOT becomed a law yet. Also, your proposed EB-2/EB-3 applicants who have continuous stay of 8 years in US without criminal record to have GC may not fit the requirement of US needed because some of these EB-2/EB-3 applicants are NOT graduated in US universities and some of them are NOT in Science, Medicine, Engineering and Techology academic major which US society in demand.
Last time I have read some other online news or forum, it talks about there is guy who was graduated in a US university with double Master degree---one is M.Sc in computer science and the other is MBA and he still get stuck in getting his first new H-1B visa and later he decided to back home without choice. So every STEM or non-STEM graduates bring money to start companies in US creating job opportunities, paying taxes and bring inflow of money----better economy is growing up.
Moreover, those graduates will invite friends/relatives to visit US, increasing sales of both international and dosmetic airline tickets, hotel reservations, restaurant reservations and uplift the profits all kinds of retail businesses. Tourist visa fees will also add monetary income. Overall, inflow of money and jobs creation are dual powers to uplift the economy.
With inflow of money from immigration, there is NO government shutdown and there is NO hiking taxes needed for the existing US companies.
Also, in Australia, it allows foreign graduates who have stayed in Australia for over 5 years and without criminal record to get the GC automatically

Now I think some major clarifications are needed here. The Receipt Date (RD) that is printed on the I-485 receipt is the date whenever queuing according to RD is needed. This is THE date wherever a FIFO is required and is as assigned as soon as the envelope containing the I-485 is received.
The ND only represents the date data-entry is made. This is the date which is mentioned erroneously as "received date" on the USCIS online system. Now this thing has been mentioned at USCIS liaison meetings by center directors and thro' AILA several times (I will post the reference as soon as I find it).

If your "real" receive date (what you see online as "your case was received on...") is within the published processing dates for your service center, and your case is straight forward, most likely it is preadjudicated. In that case, as their SOP says, they put them in PD order in waiting for the visa. See the SOP below (which is a bit out of date). You are pretty high in PD seniority. you should get a good news soon. Best of luck.

I can tell you this that i talked to representative at TEXAS SERVICE CENTER (TSC) and he flat out told me that the RD of my case is Oct 10, 2007 however the receipts i have state a RD of Aug 3rd, 2007 with ND of Oct 10, 2007. I asked the TSC rep about this and she kept saying the date keyed in our system is Oct 10, 2007 and that is the date we go by.
I have asked my lawyer to send a formal query and have also sent email to TSC after talking to National Service center as NSC recommended me to send a letter to TSC. My lawyer believes they will honor Aug 3rd but if i do not hear anything i will take INFOPASS and drill it down.

On the contrary Air India is one of the best airlines now and I fly air India all the time .
You might not find young women in tight skirts as the cabin crew but the service of the middle aged Air-India crew is very good.
They have spanking new 777's with wide seats and latest entertainment systems. Tickets are real cheap and round trip to India can be as low as $650 to $700 with taxes per person . When flights are empty I can streach on 3 seats and sleep . JFK to Mumbai nonstop is only 13 hours , sometimes done in 12 also , which is what I spend sometimes when I travel from NYC to LA . On the contrary if you go through Europe it takes like 26 hours and immigration and all the hassle in London/Frankfurt and unecessary waste of time .Air India meals are Indian and not sphagetti and pasta like the western airlines( not to hurt the sentiments of the pasta , spagetti lovers ).
The staff is generous and many times I have been offerred multiple meals on the airline when they see that a person my size ( 6' 1) has to survive on a small morsel like that . :D. Drinks when asked are served generously.
The staff is very good and polite and last but not the least , it is my national airline .
Off course the airline has been affected because of some mismanagement and I consider the Indian government to be responsible for the same not the airline staff , cabin crew and pilots .

What I need to do now? My I-94 has wrong expiration date (I entered in US on 03/07/2007 and I got I-94 with expiration date as 01/10/2007). My attorney told me that it can be explained later. So, I've already file my 485 with a bad I-94.
Please let me know if anything can be done or still I can do something to correct this issue.
