    Why dont you call VFS and find out what's happening and if they can help you to resolve this?

    The VFS website says the consulate is still holding the passport. My wife also applied for H1B on the sameday/sametime and she got her passport within 3 days. I doubt i am stuck because of this new PIMS rule. Should i send an e-mail to the consulate to confirm it?

    Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.

    In my view your words "Get a life" certainly applies to the following set of people (in that particular order):


    Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.

    Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.

    Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.

    Those who build up their hopes with predictions on the next visa bulletin and go emotionally crazy when the hopes crash with the release of that bulletin. I mean c'mon ... flower campaigns? hunger strikes? Are you that naive to think it worked the first time? This ain't a factory in India and we aren't a group of union workers.


    The above form a very small group of people on this website and that is where the problem lies with your post. You are basically stereotyping all of us into a category formed by a small group of people.

    Anyway, good to know of your Canadian PR success ... good luck!

    To those who fall in the above 4 categories take the time to realize that its all in your head. Be strong and prepared mentally. You've done all you can in an honest way. If things don't work out then so be it. Sometime in the future you will realize that it was all for your own good. Move on in style to your next adventure ... it's waiting for you.

    A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)

    I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

    You mean a future employer can transfer and extend my H1 even after I entered on AP, right ?

    That would be great news. But on this very forum I did read some posts which mentioned this wasn't possible.

    I cannot stop but laugh at your insistence that USA is global economic engine. More than half of the population is in deep debt and their population is ageing fast. Students can't borrow money now on easy terms to dund their education. THere is virtually no appetite for more debt to fire the economic engine at all.

    Physical gold and silver is best to possess.

    Russians were stronger in 1970's and US crushed them to no where ,800 banks failed in 1990 and Japanese were stronger than today's Chinese economy but US smashed in 5 years

    This is good news..But the Damage is already been done..in the past.....

    I guess DOL had some 300K cases pending when Backlog center started..It adjudicated some 150K till now.( Rough Estimate) and still 150 K left.

    Even if considering 10000 Labors been substituted till now ...Imagine the wait period for rest of us. I wish this law was enacted, when they started Backlog centers..

    Anyway..something is better than nothing....Hope for the Best...for new laws regarding SKIL,CIR Etc..atleast filing 485 when Visa numbers are not available..

    Good news indeed but not that good too, becuase the companies still have a chance to use up the labor in 45 days which is definitly possible.

    Now we will be seeing many Labors filling before this becomes a law in March.

    yes. I honestly do. Having been through multiple recruitment attempts, at three different companies, in the bay area of all places: there are simply not enough qualified/interested american citizens available.


    H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.

    H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.

    Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.

    good point. However unlike the kind of work being done in the middle-east, there are a ton of companies in the US founded or co-founded by immigrants. There is a reason this place is called the land of immigrants. Handing out GCs gives these people options to start companies and many many of them do. this creates jobs, creates more intellectual capital, all within the US. In 6 years if you make a cook in Dubai leave and go back to Kerala (just picking a typical example) he is not going to do anything to compete with Dubai. You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.

    If there is any kind of immigration that I think the US does not gain much from, its the diversity lottery and to an extend the chain migration that comes from family based immigration. EB immigration is a BIG win for the US economy.

    I think we should ask them something like "When it takes 7-10 yrs for a legal immigrant to get his green card, what would be your estimate for illegal immigrants to get their green card / citizenship when they are sent to the back of the line as per your plan? Don't you think that there are more serious issues with the immigration dept (USCIS) which is one of the causes for long waits legal immigrants face? If so do you have any plans of taking a first step to fix the agency (USCIS) problems before implementing CIR, which could break the agency because of the additional 13 million application from illegal immigrants?"

    Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.

    This is nothing new but most of it is just implementing what is already in low. Thats my take on it.

    Throw your GC and become H1...then you will understand the meaning of this bill

    Got freedom? That is a very American notion that freedom is a US trait. Personally I've sacrificed so much freedom in coming here. Freedom to work for whom I choose is principally amongst them. Freedom to have a say in the government that rules over me. If we look to the future, the US is busy throwing away her freedoms almost as fast as Burma--and that is a dangerous direction. All those US WWII vets must be rolling over in their graves. "Freedom" in the US is more of a slogan than anything else, much like Eastern European countries used to have "Democratic" in part of their name. The US government has picked up a knack of kidnapping, arbitrary imprisonment, illegally spying, sabre rattling, suppressing rights generally with politically based "no-fly" lists and arrests. All the hallmarks of a tin-pot state. Plus it can't seem to get anything done right. Iraq is a mess. Deficit, mess. Sub prime loans: mess. Health care: mess. Social Security: mess. Plus the GOP is currently trying to avoid ratification of the Law of the Sea. How backward can you get??

    Personally, I've watched the US dollar devaluate against my currency by around 40%, while salaries have not changed. Is my purchasing power higher here still? Five years ago, it was a no-brainer. Now, I'd have to add it up.

    The main reason that I stay here is that I already have a life here. Objects that are stationary tend to remain so, as Newton would say. Unfortunately, that is the best reason I have to stay.

    Now I'm not going to leave the US in a huff. It'll be for greener pastures though. Americans should not kid themselves into thinking that they are the only game in town. Those days are over.

    With him lay his two youngest sons Arjuna (7) and Ganesha (12), both shot dead. In different rooms across the house they found the bodies of Karthik’s wife Subasri (39), his mother-in-law Indra Ramasesham (69), and his eldest son Krishna (19). They all appeared to have been shot to death by Karthik Rajaram.

    Police also found two suicide notes – one for the cops and one for extended family and friends -- and a will. In them, Rajaram he spoke of his financial difficulties and took responsibility for killing his family members, police said.

    I'm not anti immigrant. I'm on H1 (actually EAD with EB3 PD of Jan 2004).Almost got laid off with replacement by an L1 from TCS. Good for now for another 3 months!!

    If you still think against me, i wish you get a situation where you might get laid off and replaced by an L1

    I'm for reform for GC processing and I dont support the abuses because of L1s

    No more discussions with idiots like you

    I completely understand the situation. But believe me this bill not good for anyone but anti-immigrant. We need to fix the broken system and make sure the employee is not tied to the employer. It will take care of all the misuse and low wage. I hope you understand the point. Now they are coming for L1, then H1 and then for EAD...
