Didnt USCIS issue a Memo or something stating only one h1B filing per person?

See new 8 CFR 214.2(h)(2)(i)(G). This preclusion applies even if the petitions are not duplicative.

I don't realize why should anyone blame cableching...??
It seems to me that he just shared the information that he got and the way he understood. Would anyone else have done it any differently?
I dont think it really matters whether they have used up all visas now vs at the end of sept. Because, there were "X" number of visas to be given out and so "X" number of applicants would be chosen randomly (USCIS Lottery style..:p) and that happend...
If at all, this is a good news, that they actually finished this lottery process and so nothing will go to waste...(It would be too bad if california Lotto comes out with a winner number ticket that does not belong to anyone!!!)
And, we will never know whether this news is true or it is a misunderstanding on the part of cableching or the IO lady. (I personally dont think either of them are lying...but it could be a misunderstanding, especially with regard to category EB3 vs EB2). Regardless whether it is ture or a misunderstanding, we will see approvals coming through over next several months. (Just like what happened in June 07). So it is quilte likely that many of the waiting people would get their GCs if their names is picked up in the lottery!! So good luck to all...

She was so eloquent. Every passing day makes u feel more like a 2nd class citizen. Anyways, let us chug on. I had sent my story. The media team has also got some very important leads. Thanks to all the contributors of stories, we were able to immediately capitalize on an opportunity from a world renowned publication. We are hoping that this will be out soon.
Another US top-3 publication's article is in the works too.
As I had mentioned earlier, we have received quite a few stories and its encouraging to see people now willing to speak publicly and realizing that maybe it won't help, revealing one's story will not hurt for sure. Plus, we will never be able to conduct rallies like illegals. Approaching media with our stories is the only way to get ourselves heard.
Someone had asked a question that how many stories have we received. The answer is about 20. That might seem a lot but let me give you a very recent example of how this was too little.
We were approached by a award-winning reporter to provide her two members of IV that fit two criteria
1) Should be non-IT
2) EB1 or EB2
Given the 20 stories we had only 2 such folks that fit the criteria and they who were gracious and spoke to the reporter. The reporter then wanted to speak to one more person and we did not have any readily available person. So we had to do a crazy search for a person that fits this criteria. We were able to find someone at the last moment and we did not squander our chance. But chances are pretty high that such a thing can happen in future!
We might have a reporter who wants to write an article but is looking for an EB2 from the state of Texas. Currently we do not have anyone that fits the criteria. We would lose this chance which anyways are not easy to come by.
Also, when our IV core member met with the congressman today, he asked for someone who was suffering in his district. Fortunately our core member was from his dictrict and hence we were okay, else it would not have been a productive meeting!
So please please send us your stories......we will not reveal your info to anyone without your expressed permission. We promise....

I have been a member here since July 2007, based on the GCStatus credentials, he has created his ID just a month or so. USCIS do have some checks and balances for the subst labor cases, so its not a staright approvals for the lab subst cases. their might be a possibility few lucky ones get off the hook, but overall USCIS can weed out the dubious/fraudulent employer petitions.
Sub labor is not the only reason guys, its just the country cap which is limiting india EB-3 and EB-2. Most of the H1Bs like us coming to us ends up applying for GC, now look at the number of H1Bs coming each year from india and the total number of GCs available for india. Their is a huge gap in these numbers, so unless they remove the country cap or recaptured unused VISA numbers from the past years, we dont see any relief.
Please donate to IV and help lobbying for the admin fixes or the laws which going to help us in the long run.

Thanks for all the responses and suggestion. All your suggestions mean one thing my filling the H1 this year is near to impossible. well i understand the situatiuon and now i'm in a state to plan my moves.
Firstly can i take my OPT back and continue my current masters?? I sent the forms on say 1st of April..
Sencond, Is this an option that i file my H1 with some firm next year (2008) and after my opt expires join for a Masters/PHD course get a F1 status so that i can stay in the US, then when my H1 comes to act on Oct 2008 can i take that and withdraw from the Masters program and also change from F1 to H1??? Is this possible coz this is what i might plan to do.....

Yes, I have applied for H1-B under master's quota PP on the 3rd of April but have not recd any receipt notification...don't panic am sure we will hear something in the next 2 weeks...
but the deadline for processing premium processing cases is tomorrow (4/27). By tomorrow we should ideally be receiving the approval notifications and not still waiting for the receipt notice....

Yes, I agree. Preadjudication by no means, is a confirmed decision. It is just do as much as possible, but when the time comes, re-review the case - which can result in RFE for anything. Nothing is confirmed until decison is made. Be positive and hope for the best...

Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.
So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?
What do you guys think.

This is not a legal advice to anybody, just explaining who I did!! Risk is yours!!.
On my passport "Surname" was empty. Complete name was under "Given Name". Assuming on passport:
Given Name: �Harjinder Singh"
Surname: ......empty....
Just went to Embassy of India - Washington DC. Filled a "Miscellaneous form" and under purpose pick OTHERS and write �Name Split". Then write on form what you want.
I requested " Split my name as Given Name = Harjinder; Surname = Singh".
Attach a photo on form, pay 20$ fee and collect a corrected passport next day.
As long as you are not changing the name this should be fine otherwise what will be in advertisement " My name is Harjinder Singh and I want to declare my new name is Harjinder Singh???" unless changing a name it seem simple 2 day task via Miscellaneous form.
Rest EAD / 485 I don't know because I am not at that stage yet.

Most of us are on this forum because of the injustice that the current immigration system perpetuates.
What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.
Employers indifference, incompetent lawyers and pathetic para legals all add up to make our best years the worst. I always used to wonder how come there is not one single place where all hi tech workers can discuss their issues and work together.
The illegal immigrants have orgs like La Raza to support them, pro bono lawyers working for them and senators and reps listening to them. We are just starting to realize that we also can work together and get ourselves heard. Being highly-skilled should NOT be a handicap for us!
I just hope IV is that elusive orgs for legal skilled immigrants...

Yes...I am aware of the facts that you mention...but now that data entry is made since long, the ND has no value.
Last year when the EB2 PD's were current for 28 days in August, only those RD's whose data was entered in TSC had chance of getting GC's. In other words, receipts are now generated for all '07 fiasco filers and hence the ND has no value!
That said if a Service Center rep says about the ND replacing the RD in their system, then it is time for corrective action. With these small windows of PD being current, why take chances!
